These Terms & Conditions govern your subscription to The Email Agency’s email marketing service. By subscribing, you agree to the terms outlined below.



1. 

Subscription & Billing



  • Your subscription begins on the day of purchase and will automatically renew on the same calendar day each month.

  • Payments are processed automatically via Stripe. You authorize The Email Agency to charge your payment method on the agreed billing date each month.

  • If a payment fails, a second attempt will be made within 3 business days. If payment is not received after the second attempt, all work and production will be paused until the payment is successfully processed.

  • You may pause your subscription at any time by emailing our team at [insert email]. We’ll hold your subscription (and your request queue) for up to 6 months—no questions asked. After 6 months of inactivity, the subscription will be considered terminated and removed from our system.





2. 

Refund Policy



  • Campaign Packages:

    A partial refund of 75% of the total amount paid is available if a cancellation request is submitted within 1–7 days after project completion. After 7 days, no refunds will be issued.

  • Flow Packages:

    You are eligible for a full refund if:


    • No email flows are delivered or sent within the first month of your subscription.

    • You see no measurable improvement in email performance (open rates, click rates, conversions, or revenue attribution) within 60 days of flow implementation.




All refund requests must be submitted in writing to [your email address], and must include clear reasoning and relevant data for review.


Content Usage & Marketing Rights



  • By subscribing, you grant The Email Agency the right to use email designs, flows, or performance metrics created for your account as part of our marketing portfolio, promotional material, and case studies.

  • No sensitive business data or personal customer information will be shared.




4. 

Client Responsibilities



  • You agree to complete the onboarding form in full before work begins.

  • Delays in providing access, assets, or approvals may result in timeline adjustments and are not grounds for refund or cancellation.

  • You are responsible for maintaining active payment methods and up-to-date contact information on file.




5. 

Service Scope



  • The subscription includes services outlined in your selected package (email flows, campaigns, SMS, account strategy, and management).

  • You may submit unlimited requests; however, only one active request is worked on at a time unless otherwise agreed in writing.

  • Larger projects may be broken into smaller tasks and delivered progressively over the course of the subscription.




6. 

Cancellation & Pausing



  • You may cancel your subscription at any time prior to your next billing cycle through your Stripe customer portal or by contacting us directly.

  • Cancellations will take effect at the end of the current billing cycle; no partial refunds will be issued for unused time.

  • Pausing options are available on request and will temporarily stop billing and production. Requests to pause must be made at least 3 days before your next billing date.

Performance Disclaimer



  • While The Email Agency strives to improve email and SMS marketing results, individual performance outcomes may vary due to factors beyond our control, including product-market fit, list health, and offer quality.
